Definition

Der Willensvollstrecker ist eine im Testament eingesetzte Person, die den Nachlass verwaltet, Schulden bezahlt, Vermächtnisse ausrichtet und die Teilung nach den Anordnungen des Erblassers vorbereitet. Die Einsetzung ist nur im Testament möglich, nicht im Erbvertrag. Die Person kann eine Privatperson, ein Notar, eine Treuhänderin oder eine Bank sein.

The executor is a person appointed in the will who administers the estate, pays debts, delivers legacies and prepares the division according to the testator’s instructions. Appointment is only possible in a will, not in an inheritance contract. The person can be a private individual, a notary, a fiduciary or a bank.
